      Sub:-Request for amendments in Transfer policy - reg

Respected Sir,
        With due respect, it is requested to please recall our discussion held with your kind honour on 28th March, 2014 on the above subject. 
2.     In the changed scenario the existing Annual General Transfer Policy needs some amendments therefore, based on the resolutions passed by General Body meeting on 22nd March, 2014, this Association request your kind honour for following amendments in the Transfer Policy:- 
 
1.   The Service Tax returns are filed half yearly online and amount of refund is also sanctioned online to the service providers. Further, Service Tax registration certificates are also provided by speed post and query of service provider, if any, are also replied online therefore, executive officers having no scope for interaction with the service providers. Further, the executive officers have no discretionary power in dealing with service tax work. In this regard your kind attention also invited towards point raised & discussed in the JCM held on 28th March, 2014 and detailed submissions through Service Tax Division, Jaipur.
 
The workload of service tax is growing speedily and hampering the physical & mental ability of executive staff. Hence, posting in Service Tax Ranges should be declared as non sensitive & the tenure should be reduced to 1 year only too with local shifting in Central Excise Range and vice versa.
 
2.   The audit wing needs vast knowledge & experience of the Law & Procedure. The existing Transfer Policy is silent about the minimum experience of Inspector, which results in posting of quite junior Inspector in audit wing. This practice neither helpful for junior Inspector nor for audit wing/administration therefore, experience of minimum 5 years service should be inserted in the Transfer Policy for posting in audit wing.
 
3.   The existing Transfer Policy is also not clear on equal exposure of all postings/Commissionerates, which resulting frequent allocation of some Inspectors in a particular posting/Commissionerate. The terms of equal exposure of every posting/Commissionerate should be inserted in the policy and priority should be given to Inspectors having zero/less exposure in such postings/Commissionerates. 
 
4.   The lady Inspectors should not be transferred from their settled station as far as possible.
 
3.     Sir, apart from the above it is worthwhile to mention here that today most the department work is carried out through internet therefore, laptop alongwith internet should also be provided to every Inspector for official use.

Sub:-Request to sanction/allot additional posts to meet growing workload of the increased Customs formations of the existing Customs Commissionerate, Jodhpur (Hqrs at Jaipur) during implementation of Cadre Restructuring - reg

Respected Sir, 

            With due respect, this Association would like to draw your kind attention towards your office letter C.No. II-2(03)Admn/CCO/JZ/2013/583 dated 22nd January, 2014 sent by Shri Shashi Bhushan Singh, the then Chief Commissioner (now the Member [CE] CBEC) whereunder a justified proposal was forwarded to the DG (HRD) for creation of new Customs Commissionerate in addition to the existing Customs (Prev) Commissionerate, Jodhpur (Jaipur) to meet growing workload of the increased Customs formations in Rajasthan. 

2.       It has been learnt that the Committee of Operational & Reorganization Issues for implementation of Cadre restructuring has not agreed with the said proposal and not recommended new Customs Commissionerate in Rajasthan in their report submitted to the Board. It is surprising to note that the said Committee has even not recommended additional posts to meet the growing workload of increased Customs formations. 

3.       The existing Customs (Prev) Commissionerate, Jodhpur (Hqrs at Jaipur) is having jurisdiction over the entire state of Rajasthan comprising 3,42,239 square kilometers of land area i.e the largest state of India. This Commissionerate is also having jurisdiction over 1077 kms long Indo-Pak International border across four districts of Barmer, Jaisalmer, Bikaner & Sriganganagar. This border is vulnerable and prone to smuggling of narcotic drugs, commercial goods, fake Indian currency, arms and ammunition and sensitive items of national importance. Besides the threat of smuggling from the Indo-Pak border, there are three Opium growing districts in Rajasthan i.e. Kota, Baran & Chittorgarh. The existing Customs (Prev) Commissionerate was created with the prime objective of prevention of smuggling activities across Indo-Pak border as well as drug trafficking within the jurisdiction. 

4.       However, in addition to the primary function, the Commissionerate is also handling the assessment and public facilitation related work at 2 Air Cargo Complexes, 4 ICDs, 1 Foreign Post Office, 1 Land Customs Station at Munabao (Barmer) & 1 International Airport at Jaipur. The most of the increased Customs formations were created after the last Cadre restructuring-2002 and too without sanction of any additional staff. In addition to this, proposals for 3 more ICDs at (i) CONCOR Khatuwas (Nimrana-Alwar), (ii) TDP Hirnoda (Fhulera-Jaipur) and, (iii) KRIBHCO Hindaun City (Karuli) are pending with the Board for consideration. The Preventive staff posted at Jaipur, Jodhpur & Churu are also attending factory stuffing work in addition to their regular preventive duties. The work load of the existing ICDs in respect of Import/Export handled during the last 10 years has increased manifold. 

5.       At present, both preventive & assessment related work is being looked after by the Customs (Prev) Commissionerate of Rajasthan, without any commensurate sanction/increase in the strength of the staff due to increase in workload. The staff for these increased Customs formations is being diverted from various Customs Preventive formations located at a distance of 250 to 350 kms. Thus, the old sanctioned strength of Customs (Prev) Commissionerate is not sufficient to handle the increased preventive, assessment & facilitation work. The executive staff is under atrocious work pressure and has to attend sensitive duties performing journey of 250 to 350 kms. 

6.       In the year 1987, the Ministry has sanctioned 54 posts in different cadres vide their letter F.No. A-11013/20/85 Ad.IV dated 7.01.1987 with condition that “the filling up of the posts for manning the LCS at Munabao will however coincide with the opening Rail link with pakistan in Rajasthan Section. The date for filling up of these posts will be notified separately by CBEC in consultation with IFU”.  Apart from the LCS, Munabao (Barmer), International Airport also become operational at Jaipurl and the work related to customs clearance is being handled by staff drawn temporarily from other Customs preventive posts/formations, but neither the aforesaid sanctioned posts nor any additional posts have arrived in the name of this increased work.         

7.       Though, the proposal for creation of new Customs Commissionerate has not found fit by the aforesaid Committee, but it is pertinent to mention before your kind honour that the aforesaid increased workload of increased Customs formations has also not taken into account that is why that even additional posts have also not been recommended to the Board by the said Committee. This appears injustice with staff of Customs (Prev) Commissionerate of Rajasthan and will also have adverse effect on working of Commissionerate. 

8.       In view of above, your kind honor is requested to please forward our request to the Chairperson, CBEC, New Delhi alongwith justified & valuable recommendation for sanction of additional posts for smooth & effective functioning of Customs (Prev) Commissionerate of Rajasthan.
