Present status Vs Genuine demands

The CR will be approved by the Union Cabinet on 07.11.2013 positively.
 
Yes....   Today (AN), the CC (Jaipur Zone) has forwarded our below mentioned demands alongwith his strong, reasoned and favorable recommendations. Now, we have to struggle at Delhi with your valuable support. Please be ready for any action in case our genuine demands are not considered by the Board. 
 
Dear Colleagues, 

The Association members are asking some information regarding present status viz-a-viz proposed formations, posts of Superintendent in Rajasthan. Some of them are having their own calculation regarding number of posts of Superintendent for promotion during implementation of the ongoing Cadre Restructuring (CR). Therefore, it is my prime duty to publish the material facts relating to this matter, which is as under:- 

As per proposals of ongoing Cadre Restructuring, existing 2 CE Commissionerates are to be re-organized into 4 CE Commissionerates without any change/re-organization of existing 1 Customs Commissionerate. As per the said proposals, there will be only 80 Superintendents in new model of each Commissionerate therefore, total sanctioned strengthen of Superintendent appears to be 400 (80x5) posts. Today, sanctioned and working strengthen of Superintendent is 278 in Rajasthan therefore, during implementation of the CR only 122 (400-278) posts (approximately) appears to be available for promotion. On the basis of these posts, Inspectors upto batch of 1993 will only be promoted in 2014 after completion of 20 to 23 years. 

*       Thus, the prevailing acute stagnation is not going to be reduced or removed on the basis of the existing proposals of CR. 

** Some of our colleagues are discussing on creation of Audit Commissionerate in Rajasthan. In this regard, it is a material fact that the total number of 7637 posts of Superintendent were proposed & cleared by the Ministry of expenditure, but only 5150 posts of Superintendent have been cleared by the DOPT & COC. This has been resulted in cut of 2487 (7637-5150) posts of Superintendent that is why that Audit Commissionerate is appears to be allocated/sanctioned to Customs & Central Zone only as per discretion of the competent authorities of CBEC whereas in the original proposals Audit Commissionerate was proposed for every Central Excise & Customs Zone.
 

*** It has also gathered from the reliable sources that posts of Superintendent shown as 80 in new model of each commissionerate are not the final one due to the aforesaid reason. 

**** Some of our friends are calculating about 40 posts of Superintendent for consequential promotion on account of promotion to the grade of Assistant Commissioner during the CR. In this regard, it is to inform that as per history of such DPC, the same will be concluded at a very late stage. Further, fate of the said DPC is not known to anyone and possibility of litigation cannot be ruled out in this matter. Further, on the basis of those uncertain consequential posts, Inspectors upto batch of 1994 will only be promoted in 2014 after service of 20 years. 

In view of above, the Association team have not option except to do all out efforts on the following genuine & justified demands to remove/reduce the stagnation of our Cadre:- 

(A) (i) Creation of Audit Commissionerate in CE(JZ) as per the norms.
                         And
                   (ii) Creation of exclusive Service Tax Commissionerate in CE (JZ).
                        And
              (iii) Creation of new Customs Commissionerate in Rajasthan.       

(B) (i)  Creation of Audit Commissionerate in CE(JZ) as per the norms.
                 And
                   (ii) Creation of exclusive Service Tax Commissionerate in CE (JZ).
                               OR
             Sanction of separate 42 posts of Superintendent and 86 posts of Inspector for Service Tax administration as per the norms.
        And
      (iii) Creation of new Customs Commissionerate in Rajasthan.
                 OR
Sanction sufficient posts for International Airport, Jaipur and   LCS, Munabao. 

Our detailed representation is under examination by the Chief Commissioner of Central Excise (Jaipur Zone) i.e. Cadre Controlling Authority and likely to be forwarded alongwith his favorable recommendations in this week. 

As published earlier, the Association team had met with the Chairperson, Member (P&V), Director General (HRD) & Addl Director General (HRD) and apprised them about pity working conditions & acute stagnation in our cadre and also submitted representation. The discussion was positive as all the authorities principally agreed with our reasoned submissions and noted our demands for consideration during implementation of the ongoing CR after approval by the Union Cabinet. 

The Cabinet note is under the prescribed process for presentation before the Cabinet and will to be approved on 07.11.2013. 

We are also planning for Delhi visit once a week for regular pursuance, effective watch on day to day developments and to safeguard our common interests. 

*The efforts of our energetic Comrade Abhay Singh, General Secretary may also be very useful as he is regular in touch with the office bearers of All India Association in this regard.

Good start

 
Dear Comrades,

As informed by Comrade B L Meena (President), in previous post, the team of AICEIA (Rajasthan Circle) met with the authorities and made vehement efforts to draw their kind attention towards acute stagnation in Rajasthan. We are regularly perusing our demand that Inspectors upto 2002 batch, must be promoted.

The request submitted before the DGHRD is posted below, if our request is considered the Inspectors upto 2002 batch will get promotion. We are very much hopeful for new Service Tax Commissionerate or additional sanction of posts for service tax. Similarly, we are sure in the matter of Customs Commissionerate because many Zones not having any international border have been proposed Customs Commissioneratae as well as Customs (Prev) Commissionerate whereas we have not given any post for Customs since the last Cadre Restructuring.

The Delegates & Divisional Representatives are requested to get the certificates from their respective DDO about the subscription to AICEIA so that the same may be forwarded to SG AICEIA.

Respected Madam,
 
          With due respect, this Association would like to draw your kind attention towards the following brief facts for smooth functioning of the administration and common welfare of executive officers working under your caring supervision:-
 
(a) As per Cadre Restructuring proposals under letter dated 11th November, 2010, the existing two (2) CE integrated Commissionerates are to be re-organized into four (4) CE integrated Commissionerates consisting model of 80 Superintendent & 120 Inspector.
 
(b) As per the said proposal, “each of the Central Excise & Service Tax Zones would have one Commissioner (Audit) and one Commissioner (Appeals)”.
(Please peruse page 50 of Cadre Restructuring proposals)
 As per staffing model of Audit Commissionerate there will be 80 Superintendents and 80 Inspectors.
 
(c)  The existing Customs (Prev) Commissionerate of Rajasthan has neither been proposed for re-organization nor been proposed for more strengthen, despite of considerable increase in Customs formations.
 2.       It is a material fact that during the last 2 years the state of Rajasthan has witnessed a tremendous growth in work of Service Tax, but the manpower has remained unchanged. The executive officers are working under atrocious workload of Service Tax and It will not be out of place to mention here that rapidly increasing workload of Service Tax would be out of control despite of proposed re-organization of existing CE Commissionerates that is why this Association has requested for creation  exclusive Service Tax Commissionerate.
 3.       Similarly, after the last Cadre Restructuring-2002, many Customs formations including most sensitive formations like- International Airport, Jaipur and Land Customs Station, Munabao (Barmer) has been increased, but additional staff has not been for smooth functioning & effectively monitoring of these increased Customs formations and temporary arrangement has been made by drawing staff from various Customs preventive formations of existing Customs (Prev) Commissionerate of Rajasthan. As per staffing norms & proposals of ongoing Cadre Restructuring, Customs Commissionerates will have 80 Superintendents and 120 Inspectors. Thus, the existing sanctioned strength of Customs (Prev) Commissionerate of Rajasthan will be reduced rather than to increase in light of increased Customs formations. For example – Now, there will only 120 Inspectors against working 158 Inspectors. Thus, creation of new Customs Commissionerate in Rajasthan is the need of the hour otherwise, Customs preventive measures and Customs facilitation work will be affected adversely.
 4.       Further, it has gathered from some reliable sources that the proposed Audit Commissionerates are not being sanctioned to each of the Central Excise and Service Tax Zones. It appears that Audit Commissionerates will only be sanctioned on the basis of strong recommendations of the jurisdictional Chief Commissioner and Commissioner. Thus, the overloaded and stagnated members of this Association are under fear of consequences.
 5.       Madam, It is worthwhile to mention here that if (i) proposed Audit Commissionerate, (ii) exclusive Service Tax Commissionerate and, (iii) new Customs Commissionerate are not sanctioned in Rajasthan, it will increase the existing system imbalance and adverse affect on the professional output of the officers of this esteemed department, who has been guard of nation’s economic frontiers against all odds. Besides, the stagnated professional as well as administrative growth of the department may indirectly hamper the growth of revenue in Rajasthan.
 6.       The workload of Service Tax had already been realized in the proposals of ongoing Cadre Restructuring therefore, this Association would also like to draw you kind attention towards following terms envisaged under Chapter-13 for re-organization of field formations:-
 
C.     Norms proposed to be used in current Cadre Restructuring & Reorganization:
           (a)    Central Excise Commissionerates:-
 
……….   .The Commissionerates located in an area, which is not covered by an exclusive Service Tax Commissionerate, would be provided with the staff equivalent to the staff allocated to one Division exclusively for Service Tax. Additional Staff equivalent to one Range would be provided to the Commissionerates having Oil Refinery under their jurisdiction”.

 7.       In view of above, in case sanction/allocation of Service Tax Commissionerate is not possible for CE (Jaipur Zone) then posts envisaged under aforesaid terms may at least be sanctioned to the CE (Jaipur Zone) to meet out rapidly increasing workload of Service Tax. Thus, CE (Jaipur Zone) is entitled for sanction the posts equivalent to staff of 4 Divisions and 1 Range in addition to staffing norms for proposed re-organizing 4 Central Excise integrated Commissionerates of Rajasthan. 
8.       Madam, the staff position viz-a-viz pity working condition of the executive officers working in Service Tax Division, Jaipur may please be taken into consideration for requirement posts of executive officers. Though, the minimum requirement for Service Tax Division is 10 Superintendents and 20 Inspectors. Similarly in CE Range having jurisdiction over Oil Refinery there may be 2 Superintendents and 6 Inspectors.
 
9.       In view of above, your kind honor is requested to please get sanctioned/allocated at least 42 (10*4+2) posts of Superintendent and 86 (20*4+6) posts of Inspector separately for possible smooth functioning of Service Tax administration in absence of exclusive Service Tax Commissionerate.
 
10.               Madam, this Association has already submitted detailed representations dated 30.09.2013, 03.10.2013 and 10.10.2013 (copies enclosed) to the jurisdictional Chief Commissioner of Central Excise (Jaipur Zone), Chief Commissioner of Customs (Prev) Zone, New Delhi and the respective Commissioners of Central Excise as well as Customs. It is pertinent to mention here that jurisdictional Cadre Controlling Authority i.e. the Chief Commissioner of Central Excise (Jaipur Zone) has agreed with our demands and has already forwarded his judicious recommendations vide letter C.No. II-39(11)CCO/JZ/ET/2011/6941 dated 4.10.2013 to the DGHRD, New Delhi in reply to your letter F.No. 8/B/154/HRD(HRM)/2013 dated 03.09.2013. 
11.     In view of above, being guardian of the Association member, your kind honor is requested for sympathetic consideration on our following genuine & justified requests:- 
(A)    (i) Safeguard sanction of the proposed Audit Commissionerate in CE(JZ).
                  And
         (ii) Creation of new Customs Commissionerate in Rajasthan
                  And
        (iii) Creation of exclusive Service Tax Commissionerate in CE (JZ).
(B)     (i)  Safeguard sanction of the proposed Audit Commissionerate in CE(JZ).
                  And
        (ii) Creation of new Customs Commissionerate in Rajasthan
And
(iii) Creation of exclusive Service Tax Commissionerate in CE (JZ).
                  OR
  (iii) Sanction of separate posts for proposed four (4) Central Excise integrated Commissionerates under CE (Jaipur Zone) as per the aforesaid staffing norms for Service Tax administration.

Meetings with authorities of the CBEC


Dear Colleagues,
 
I, alongwith S/Shri Anil Gupta –Vice President, Abhay Singh – General Secretary & Alok Mathur –Asstt Gen Secretary visited Delhi on 17th & 18th October, 2013.
 
Though we had no prior appointment, but succeeded to meet with Hon’ble Chairperson, Member (P&V), DG (HRD) & Addl DG (HRD) on the basis of united efforts.
 
During discussion, we apprised all the above authorities about pity working conditions & acute stagnation in our cadre and also submitted representation. The discussion was positive as all the authorities principally agreed with our reasoned submissions and noted our demands for consideration during implementation of the ongoing Cadre Restructuring after approval by the Union Cabinet. The Cabinet note is under the prescribed process for presentation before the Cabinet and likely to be approved on 31.10.2013.
 
We have also met with 2 Chief Commissioners for favorable consideration of our demands and are hopeful that they will also convince the above authorities in support of our demands/claims. The CC of Customs, Customs (Prev) Zone, New Delhi was not available in his office, therefore our team will meet with him during next visit.
 
Apart from above, we also met some relevant officers & other colleagues and gathered some important facts/procedure, which will help us to decide further line of action. The same can only be discussed in General Body meeting, being organized shortly.
 
It appears that the existing proposals & norms are not the final for sanction of Commissionerate/posts and the same will be decided only after approval by the Cabinet. As on date, the final position is only that our 2 CE Commissionerates are going to be reorganized into 4 CE Commissionerates. On the basis of this final position only 100 to 120 Inspectors upto batch of 1993 will be get promoted after completion 20 to 22 years service.
 
We have submitted our strong & reasoned submissions for creation of Audit Commissionerate, Service Tax Commissionerate & Customs Commissionerate in Rajasthan.  The prevailing acute stagnation can only be reduced/removed only on creation 2 Commissionerates form the requested 3.
 
The contribution of Shri Anil Gupta and Shri Alok Mathur is notable for all office bearers & members of the Association as they spared time despite of time bound workload and reached Delhi traveling long distance in our common interest.

Comrade Abhay Singh is continuously in touch with office bearers of All India Association for removal of regional disparity and his result oriented efforts may be the milestone for career of our cadre.

 
Thus, we are doing our all out efforts, but still have to do regular & tireless/vigorous efforts in this direction. We are also planning to depute a well conversant & effective delegation  for Delhi visit once a week for regular pursuance and to watch/safeguard our common interests.

Review and further line of action

Dear Colleagues,
                     दुर्गानवमी और विजयदशमी के पावन पर्वों पर हार्दिक बधाइयाँ एवं शुभकामनाएँ..... !!!
Today, we have reviewed the efforts made from 22.09.2013 onwards for betterment of our Cadre. We have also received many verbal suggestions and advices from the Association members. On the basis of feedback, it appears that new team of the Association has given good start, but still have to do continuous hard work to achieve the goal. We have discussed and decided further lines of action for possible betterment of the Cadre. Now, the Association team consisting well conversant & effective office bearers/members will visit Delhi on frequent intervals for discussion with the competent authorities and for close watch on day to day developments to safeguard/monitor our common interest. A separate team is also being constituted to obtain political approach/intervention for the justice. The progress will only be shared with all of you in General Body meeting or through e-mail after at least 2 visits.
 
We welcome your creative suggestion during the crucial period before finalization/implementation of the ongoing Cadre Restructuring. We therefore, request all the Association members/Delegates/Divisional Representatives/Office Bearers that:-
 
1. The unity is a basic need for our effective activities of the Association and the unity is only the strength of Office Bearers. If denial from justice is realized during the proposed visits/discussion with competent authorities of the Board/DGHRD, all the united members should be ready for DO or DIE action for the justice/parity in coming CR.Therefore, please do the needful to create environment of activeness/awareness in the Association members for the possible action.
 
2. DDO Certificates alongwith membership form are also required to establish unity. Therefore Assistant General Secretary of concerned Commissionerates, Delegates & Divisional Representatives are requested to please make 100% membership and also obtain DDO Certificates on TOP PRIORITY basis.
 
3. Please submit creative suggestion/advise/comments also through this blog so that the same can also be viewed by all the Association members. It will also help us to establish transparent activities of the Association.
 
4. Please remain in touch with each other and also spare time for the Association activities directly or indirectly daily at least for 30 minutes.
 
5. We all are responsible for the prevailing stage of stagnation and all of us want justice/parity in promotion, self-respect & social respect/image. Now, united all out efforts are only the need of the hour to obtain our rights/respect.

2nd round of meeting with the Commissioner, CE, JPR-I - Revised representation

Dear Colleagues,
                        Good afternoon.
 
As per the scheduled programme, today I again met with Dr. Sandeep Srivastava, the Commissioner, CE, JPR-I and discussed all possible positive points to get maximum post of Superintendent during the ongoing Cadre Restructuring. The 2nd round of discussion remained very responsive and cooperative. The Commissioner extended his full cooperation too with personal interest looking into the acute stagnation in our Cadre as well as genuine demands based on justified and reasoned submissions.
 
This Association is very thankful to the Commissioner as he has forwarded our today's representation by FAX to the DGHRD immediately on conclusion of the meeting and telephonically discussed with the authorities of the DGHRD accordingly.
 
Now, the Association team has completed the best possible homework before personal visit/discussion with the DGHRD and competent authorities of the Board. Our team will again meet with Dr. Sandeep Srivastava, the Commissioner, CE, JPR-I before leaving for Delhi.
 
Please hope for the best and pray the almighty for the same. Please remain in touch through this blog and also submit your creative suggestions for the best result. The next line of action will be decided after discussion with Comrade Abhay Singh, Gen Secretary immediately on his return at Jaipur. The programme will be published accordingly.
 
As per my reliable source, the CR proposals will be get approved from the Uninion Cabinet on 17.10.2013.

7.       In view of above, in case sanction/allocation of Service Tax Commissionerate is not possible for CE (Jaipur Zone) then posts envisaged under aforesaid terms may at least be sanctioned to the CE (Jaipur Zone) to meet out rapidly increasing workload of Service Tax. Thus, CE (Jaipur Zone) is entitled for sanction the posts equivalent to staff of 4 Divisions and 1 Range in addition to staffing norms for proposed re-organizing 4 Central Excise integrated Commissionerates of Rajasthan. 
 
8.       Sir, the staff position viz-a-viz pity working condition of the executive officers working in Service Tax Division, Jaipur may please be taken into consideration for requirement posts of executive officers. Though, the minimum requirement for Service Tax Division is 10 Superintendents and 20 Inspectors. Similarly in CE Range having jurisdiction over Oil Refinery there may be 2 Superintendents and 6 Inspectors.
 
9.       In view of above, your kind honor is requested to please get sanctioned/allocated at least 42 (10*4+2) posts of Superintendent and 86 (20*4+6) posts of Inspector separately for possible smooth functioning of Service Tax administration in absence of exclusive Service Tax Commissionerate.
 
10.    Sir, since the ongoing Cadre Restructuring is being approved by the Union Cabinet shortly therefore, your immediate intervention in this matter is highly solicited for smoothing function of administration as well for justice to the overloaded & stagnated members of this Association. Therefore, being guardian of the Association member, your kind honor is requested to please extend your kind cooperation on our following genuine & justified requests:-
 
(A)    (i) Safeguard sanction of the proposed Audit Commissionerate in CE(JZ).
                  And
         (ii) Creation of new Customs Commissionerate in Rajasthan
                  And
        (iii) Creation of exclusive Service Tax Commissionerate in CE (JZ).
 
(B)     (i)  Safeguard sanction of the proposed Audit Commissionerate in CE(JZ).
                  And
          (ii) Creation of new Customs Commissionerate in Rajasthan
And
(iii) Creation of exclusive Service Tax Commissionerate in CE (JZ).
                  OR
   (iii) Sanction of above mentioned separate 42 posts of Superintendent and 86 posts of Inspector for Service Tax administration.
