Repy to the Board for Justice

Dear Comrade,

The FM has approved implementation of CR-2013 on 10th May, 2014 and notifications regarding the jurisdiction of re-organised Commissionerates and allocation of manpower will be issued shortly, but tireless efforts are continue for parity & justice with our Cadre. On being asked views by the Board, Rajasthan Federating Circle submitted opinion/suggestions on 10th May, 2014 to our Federation. On the basis of suggestions, our Secretary General has submitted final reply/views to the Board reiterating for all India seniority and not to reduce the existing qualifying service of 8 years for promotion to the grade of Superintendent. The meeting now has scheduled for 19^th May, 2014 therefore, please remain united in common interest of the cadre and hope for the best.

Service Tax Posting

Dear Comrades,

In continuation to last dated 28^th April, 2014, it is to inform all of you that during the Association’s individual meetings with the Chief Commissioner (Jaipur Zone), Commissioner, CE Jaipur-I and Additional Commissioner (CCO), they were agreed on our demand to declare Service Tax formations as non-sensitive OR to reduce tenure from 2 to 1 year.

It was also informed through post dated 8^th May, 2014 that the Administration appears not agree to accept our genuine demand. All of you were also asked to submit your opinion/suggestions urgently through comments on Blog/sms/mails/calls so that further lines of action can be decided accordingly.

Friends – The Association can get success only through active & united cooperation of its member –“One for All – All for One”.

The administration has started AGT accepting our other demands (i) station tenure of Bhiwadi for 2 years only (ii) posting in Audit of Inspectors having service or more than 5 years (iii) equal exposure in all three Commissionerates/posting to everyone examining/comparing his HOP etc.

Our above mentioned demand for Service Tax formations is not being accepted by the administration. All of you are once again requested to send your united opinion/suggestion alongwith strategy to fulfil the demands, failing which all of us will have no option except to face the results of posting in Service Tax formations i.e. overloaded formation.

All the Divisional Representatives, Delegates and Office Bearers are requested to discuss this time bound issue with all colleagues and send united suggestion & lines of action without further loss of time.

Finally, today CR Notification file approved by the FM (10th May, 2013)

Dear Comrades,

In continuation to the last post published in night of 9/5/2014, it is to inform all of you that file for implementation of CR-2013 has approved by the Finance Minister today at 11.00 am.

The notifications for re-organised Commissionerates and allocation of manpower will be issued shortly, as per approval of the Cabinet. 

The Board authorities have also give undertaking to the Revenue Secretary for removing the existing regional disparity in promotions of Cadre, but our key representatives of Federation have to deal with matter diplomatically & promptly for justice to the Cadre during implementation of the CR.

News from Delhi (at 10.30 pm on 9th May, 2014)

Dear Comrades,

Our Delhi source has reported that the Finance Minister has called for all the important & time bound files tomorrow (Saturday) for discussion/decision. Further, the Chairman, CBEC has also give undertaking to the Revenue Secretary with reference to remove the existing regional disparity in promotions in our Cadre, but our key representatives of Federation have to deal with matter diplomatically & promptly in common interest.

Thus, there is great possibility of discussion & decision on notifications for implementation of CR in CBEC because the IRS lobby trying their best and stated even approached the FM for the same without further wait.

CR OR AGT

Dear Comrades

 

The IRS lobby trying very hard to get the CR notifications issued on or before 15th May, 2014, but it can't be said as to whether CR will be implemented by hand of the present Government or not. The said lobby is also trying for their AGT to get the desired posting.

 

As per the reliable sources, after intervention by the Revenue Secretary our Federation has not been called for discussion therefore, it appears that the Board authorities are willing to implement the CR to fulfil their own interest and not appears positive to extend natural justice to our Cadre.

 

Friends - AGT in Rajasthan is under progress, but the administration appears not agree to accept our one demand either to declare Service Tax formations as non-sensitive or to reduce tenure from 2 to 1 year. Please send your urgent opinion/suggestion in this regard through comments on blog/sms/mail/mobile so that appropriate action can be taken. Please do the needful urgently as the final round discussion with the administration is expected today or tomorrow.

Why the CR being delayed ?

Dear Comrades 

As published earlier, it is correct that fate of CR-2013 is with the Board authorities for its implementation or non implementation within the prescribed time limit. As also reported earlier, the IRS lobby wants implementation of CR fulfilling their own interest even without bothering the natural justice with their own subordinate executive officers. 

The original proposals of CR were approved by the Union Cabinet on 5^th December -2013 and was to be implement only by notifying the jurisdiction of old + new Commissioneratres and allocation of manpower as per sanction of the Cabinet.  

It appears that the IRS lobby were under impression that they are supreme authority to interpret & implement approval of the Cabinet ensuring their own interests that is why that the Board authorities constituted some Committees also assigning work to examine justification of approved Commissionerates under various Zones of the CBEC, which was already examined & justified in 2010 by the various Study Groups and was finalized before its presentation & clearance/sanction from the Ministry of Expenditure, DOPT, Group of Secretaries and Union Cabinet.

 

On the basis of futile exercise of the said Committees, the Board authorities prepared notifications by reducing & increasing number of Commissionerates in various Zones for final approval of the Revenue Secretary, MOS & FM. Thus, the Board authorities tampered with the original proposal of CR, even after approval of the Cabinet that is why that the Revenue Secretary denied to submit the same to the Finance Minister for final approval. 

On the other hand, our Federation/Association were assured by the Board authorities on the various occasions/meetings for removal regional disparities in promotion by implementing all India seniority of Inspector Cadre (as per decision of the Apex Court) during implementation of the CR, but after approval of the Cabinet and reports of the said Committees the Board authorities are not agree to fulfill their assurances that is why that our Federation has appraised the Revenue Secretary about acute discrimination with Inspector Cadre and submitted representation for removal the regional disparities in promotion by implementing all India seniority.

 

As per reliable sources, the Revenue Secretary is very much annoyed on both the above issues and has given some directions to the Board authorities. As per latest position the Board authorities are agreed and prepared notifications to implement the CR as per the original proposals and approval of the cabinet, but appears not willing to solve the long pending and assured grievances of Inspector cadre.

On the other hand the Board authorities approved relaxation in qualifying service from 8 to 2 years, which will increase the existing regional disparity in promotion and Inspectors having service of only 2 years will be promoted much before their very - very seniors. Can be expect such type of injustice from our own senior officers ? 

 

As per another source, now the IRS lobby trying very hard to convince the Revenue Secretary for approval of the notifications by the FM on or before 5^th JUNE, 2014 i.e. within prescribed time limit of 6 months after approval of the Cabinet, failing which the entire proceedings of CR will be processed afresh too on the mercy of the new Government.

 

The God may bestow wisdom to the IRS lobby to agree with the genuine demand of Inspector Cadre for the sake of natural justice, otherwise many IRS officers & Executive officers will have no option, except to retire without awaited promotion.
