Representation for new Commissionerates and meeting with the Chief Commissioner & Commissioners





Dear Association members, Divisional Representatives & Delegates,

Good evening

Today newly elected team of the Association visited the Chief Commissioner, CE (Jaipur Zone) and respective Commissioners of all the three Commissionerates.  The CC & Commissioners welcomed the newly elected team and assured their best cooperation for welfare of the cadre.During visit we discussed on the burning issue of stagnation & regional disparity in promotion avenues in our cadre and the possible remedies  to reduce the stagnation.

We also submitted a representation requesting for creation of two (2) Service Tax Commissionerates  one (1) Customs Commissionerate in addition to the proposals of the ongoing Cadre Restructuring. The respective Commissioners patiently heard and agreed with our reasoned submissions and assured their needful positive action in the matter. We hope that the matter will be examined by the Commissioner, CE, Jaipur-I with personal attention as discussion with the said personality was very much positive & suggestive.

Our team has also undertaken time bound home work for further course of action in this regard.

Sub: Repuest for creation of new Service Tax Commissionerates & Regular Customs Commissionerate, during ongoing Cadre restructuring - reg
              
             With due regards, the Association beseech your goodself to pay kind attention towards pathetic working conditions of the Inspector & Superintendent cadre, owing to multi-fold increase in the Customs, Central Excise & Service Tax work load in the State of Rajasthan. Though during the recent years the state has witnessed a significant increase in Customs, Central Excise & Service Tax Revenue, Assessee/Service Provider Base, Work Load etc., but the administrative set-up including the strength of employees has remained unchanged. It has created a system imbalance and has been adversely affected the professional output of the officers of this esteemed department. The stagnant professional as well as administrative growth of the department in the state of Rajasthan may indirectly hamper the growth of revenue. Besides, the stagnant set-up has thwarted the revenue growth and in the absence of motivational scenario the work culture appears loosing inspirational impetus.
 
Moreover, the State of Rajasthan has ample potential for formation of new Central Excise, Service Tax and Customs Commissionerates. The state possesses a vast spread geographical area, a huge number of Assessee/ Service Provider/Importer-Exporter base and above all a substantial amount of total annual Revenue. Furthermore, the state of Rajasthan deserves more commissionerates than the proposed commissionerates in the ongoing Cadre Restructuring on the basis of its Assessee/Service Provider base and also as per the revenue of Customs, Central Excise & Service Tax in the state. This association has carried out a study, which shall put forth our claim strongly and logically for the formation of more commissionerates. It is most humbly requested to please pay personal attention on our point wise submission enumerated below:
 
(A)      Norms of Cadre Restructuring for creation of new Commissionerate:-
              The projected revenue for the year 2010-11 has been taken into account for reorganisation of existing Commissionerates during the ongoing Cadre Restructuring and the proposed norms are as under:-     
 (i)Central Excise Commissionerate- Revenue Norms- Rs.1750 crors Central Excise annual Revenue (PLA+Cenvat)
(ii)  Service Tax Commissionerate-Revenue & Assessees base Norms- Rs. 3000 crores service tax annually revenue (PLA+ Cenvat) and more than 17500 assessee.
(iii) Integrated Customs  Commissionerate-150000 SB’s & BE’s for integrated   customs commissionerate
             Sir, The above proposed norms were fixed in year 2010 in anticipation of the workload and manpower for next five (5) years, but it would not be out of place to mention here that the very purpose/aim of ongoing Cadre Restructuring is going to be defeated before its implementation because the anticipated workload of five (5) years has already been crossed in Rajasthan and the your executive officers (Superintendents & Inspector) are working under horrendous work pressure, stress, frustration, stagnation due to acute shortage of manpower.
B:  Request for new Service Tax Commissionerates :-
             Sir, There are 69,145 assesses registered under Service tax in Jaipur Zone and the revenue collection from Service Tax was approximately 2400 crores during the FY 2012-13 (Annexure-‘A’ enclosed). During the current year (upto 11th Aug.), the revenue collection from Service tax has increased by 33.53% in comparison to the corresponding period in the previous year. It is estimated that revenue of Service Tax will cross 3000 crors during this financial year.
As per the norms laid down in the ongoing Cader Restructuring, the criteria for formation of new Service Tax Commissionerate, has been considered on the basis of the Revenue Collection and also on the basis of Number of Service Providers registered. Either 3000 crors revenue or more than 17500 assesseee satisfies the norms for creation of new Service Tax Commissionerate. It would be imperative to mention that the Jaipur Zone fulfils both the criteria for formation of a new Service Tax Commissionerates.
            Sir, the state of Rajasthan is widely spread over 3, 42,000 Sq. Km. and the service tax assesses are scattered all over Rajasthan. Considering the vast geographical area, huge number of scattered Service Providers and a substantial amount of revenue, all together deserve minimum two additional Service Tax Commissionerates. Besides, the increased work load is falling adversely on the mental, social and physical lives of the staff. It is requested, the formation of one Service Tax Commissionerate may be recommended exclusively for Jaipur district, as more than 28000 assessees are registered in Service Tax Division Jaipur itself. The 2nd Service Tax Commissionerate may be recommended for rest of state considering the huge number of scattered Service Tax providers and substantial amount of revenue.

(i)                An example of workload viz-a-viz manpower in Service Tax Division:-
            Sir, As per the above proposed norms, there may be proportionately 3500 assesses with revenue of Rs. 600 crores in one Service Tax Division for better monitoring of revenue collection and smooth functioning. Service Tax Division, Jaipur is having jurisdiction over Jaipur, Dausa & some part of Tonk Districts under CE Jaipur Zone. The workload of the said Division office is indicating alarming situation since its establishment as much as there were 25211 registered assesses with revenue collection of Rs. 1,419.09 crores during the FY 2012-13.      
          Further, during starting 5 month of the current financial year revenue collection of the aforesaid Division is Rs. 629.34 croces (upto August, 2013) whereas revenue collection during corresponding period of the last financial year was only Rs. 440.61 crores. Thus revenue collection during only starting 5 months of the current financial year has increased by Rs. 188.73 crores in comparison to the corresponding period of the last financial year. Thus looking into revenue growth trend of 42.83%, it is estimated that revenue collection from single Service Tax Division, Jaipur will be more than Rs. 2,000 crores during the current financial year. 
            
             Similarly, number of registered assesses during only 5 months of the current financial year has also increased from 25211 to 27431(upto August, 2013). Thus looking into assesses growth trend of 8.81%, it is estimated in single Service Tax Division there will be more than 33000 registered assesses during the current financial year. It is also pertinent to mention here that the revenue collection can also be increased beyond this projection deploying more Superintendents and Inspectors with infrastructure facilities for effective & regular monitoring of the huge amount of confirmed & recoverable Arrears.
            Sir, under jurisdiction of Service Tax Division, Jaipur all work items of 28500 assesses (which is equivalent to 5 divisions as per the proposed norms) are being looked after only by 9 Superintendents and 17 Inspectors. The deployed executive officers doing their regular, sincere efforts even putting extra working hours, but it is next to impossible for them to cope with the atrocious increased quantum of workload. Further, regular acute storage of manpower adversely affects the professional output of the officers of this department who has been guard of nation’s economic frontiers against all odds.
           Sir, In view of above, this Association’s claim of rapidly expanding of workload specifically in Service Tax sector is clearly establishes only from above single example.
 
 (ii)              Justification of 2 exclusive Service Tax Commissionerates:
         Sir, the state of Rajasthan is widely spread Trans 3, 42,000 Sq. Km. and the service tax assesses are scattered all over Rajasthan. Thus geographically condition of Rajasthan is typical in comparison to other States/Zones and also fulfilling the proposed norms for creation at least two (2) Service Tax Commissionerates for smooth functioning and effective monitoring the Government revenue. 
Considering the vast geographical area and above mentioned working condition of existing Service Tax Division, Jaipur this Association request your kind honour for creation two (2) Service Tax Commissionerates – 1st at Jaipur for speedy increasing assesses of Jaipur District and 2nd at Ajmer for wide areas of remaining districts in Rajasthan. In view of above, this Association fond hope that your goodself will be agreed with urgent requirement and justification of our request. 
 
Sir,  in this connection, it shall be pertinent to mention that the administration has already acknowledged the earnest requirement of additional staff and more service tax commissionerates for smooth administrative functioning, proper monitoring and effective check on revenue leakage. The first proposal was sent to Commissioner, Directorates of Organization & personal Management, New Delhi by the worthy Commissioner, Jaipur vide C.No. II-3927)/ET/2004 dated 29.11.2004. Thereafter, the earlier worthy Chief Commissioner sent a proposal to the Board vide letter C. No. II-39(11) CCO/JZ/ET/2011/8064 dated 14.10.2011 in compliance of Board’s letter F. No. 8/B/69/HRD(HRM)2011/2593 dated 30.8.2011 and vide reminded vide subsequent letter C. No. II-39(11)CCO/JZ/ET/2011/6900-6901 dated 24.08.2012 stressing upon the dire need for creation of an additional Commissionerate of Service Tax for smooth administration functioning. The demand of additional staff for service tax is being made regularly since 2004, through various fronts.

              Sir, the association beseech your goodself to heed towards the dire need of staff and other administrative set up. During the recent years, the Service Tax work has increased with leaps and bounds. The numbers of Service Providers are too high to monitor with hand full staff of Rajasthan. Furthermore, the time bound work in abundance is deteriorating the motivational work environment of the department. The facts regarding increased number of assessee base and increasing work are being put forth regularly by both the worthy jurisdictional Commissioners. Despite putting extra working hours the staff is not able to cope with the increased quantum of work load. It is pertinent to mention here that the officers are working under tremendous pressure & stress looking into the assigned time bound workload vis-a-vis fear of responsibility.
              Sir, your benign intervention in the matter is desperately solicited to realize the state of justice for the staff working under your caring supervision.
C:         Request for new Central Excise Commissionerates:-
                Sir, In the current cadre restructuring proposals only two new Central Excise Commissionerate are going to be sanctioned according to revenue norms on the basis of the revenue collection of financial year 2009-10 and projected revenue of F.Y.2010-11.               As per revenue norms considered in cadre restructuring proposal minimum 7 commissionerate may be sanctioned in Rajasthan. Even if the revenue from oil sector of Barmer is 4037 crors from PLA and 32 crors from Cenvat, Total revenue was 4069 crors  is deducted from the total C. Ex. revenue of F.Y. 2012-13,the remainder revenue will be Rs.11504 crors (PLA+Cenvat) for F.Y.2012-13 which is also high from the projected revenue of 2010-11.
Sir, hence, it is requested to kindly accede to our request and put forth our representation with the Central Board of Excise & Customs and also with DGHRD with your strong recommendations.

D:        Request for new regular Customs  Commissionerate:- 
      Sir, The Customs (Preventive) Zone, Delhi consists of 3 Customs (P) Commissionerate - at Delhi, Amritsar & Jodhpur. Delhi Customs has a regular Customs Commissionerate apart from the Customs (P) Commissionerate and in the ongoing Cadre Restructuring, a regular Customs Commissionerate is proposed at Ludhiana also, in addition to the existing Customs (P) Commissionerate at Amritsar. On the same ground, formation of a regular Customs Commissionerate in Jaipur Zone is highly justified.
      
     Sir, There is no regular Customs Commissionerate in Rajasthan to look after the regular work of Customs at 8 ICDs, 1 FPO, 1 Land Customs Station (LCS, Munabao), 2 Air Cargo Complexes and 1 International Airport. The regular work of above-mentioned Customs formations is being performed by the staff of Customs Preventive formation and the work related to the Private Bonded Warehouses is being looked after the jurisdictional Central Excise formations. Factory stuffing of non excisable goods is being carried out by Customs Preventive Staff as well as Central Excise Staff also. Considering the voluminous increase in the Customs related work, a separate Customs Commissionerate is desperately required. 
   Sir, it would be pertinent to draw attention to the fact that since its creation in 1997, the sanctioned strength of the Customs Preventive Commissionerate has also not been increased despite the creation of several new Customs formations in Rajasthan. 
        Sir, Although Amritsar Customs (P) Commissionerate does not qualify on revenue / work-load parameters for creation / allocation of a regular Customs Commissionerate, yet in ongoing Cadre Restructuring, the Board has considered creating an additional Customs Commissionerate at Ludhiana by bifurcating it on the following reasoning:
“..the reorganization of Customs (P) formations cannot be done on the basis of quantifiable parameters and the same has to be done keeping in view the vulnerability of geographical regions over which these formations exercise jurisdictions. Customs (P) Commissionerates should be so organized that their main focus remains Customs Preventive work and it does not get diluted by any revenue collection related functions.”
 
Para vi on page 53 of the Cadre Restructuring Proposals is also relevant to apprehend the justification of demand of our Association:
The Tuticorin & Tiruchirapally Commissionerates under the Chennai Customs (P) Zone have been retained despite not fulfilling the criterion of revenue / work-load parameter on the ground that:
“Being Customs (P) Formations, the existence of the two Commissionerates need not be justified on the basis of quantifiable parameters such as number of Bills of Entry and Shipping Bills etc. These two Commissionerates cover the entire highly sensitive coastline (except the coastline falling within the jurisdiction of Chennai Customs Zone) of the State of Tamil Nadu.”
 
Sir,  the same analogy has not been applied in the case of Jodhpur Customs (P) Commissionerate which alone exercises jurisdiction over the highly sensitive and vulnerable 1077 KMs long Indo-Pak border (as against the 561 KM long international border of Punjab state), and is area-wise by far the largest (3.42 lac Sq. KMs, as against the 0.50 lac Sq. KMs area of Punjab), topographically inaccessible and inhospitable desert / semi-arid jurisdiction spanning across the entire state of Rajasthan. 
Sir, For smuggling point of view the widely spread international border in the State of Rajasthan is extremely vulnerable for trafficking of Narcotics, smuggling of Gold & FICN and influx of Arms & Ammunitions. The role of the Customs cannot be neglected in the security of nation. Moreover, the Rajasthan’s topography is desperately needs more attention of the department with increased manpower and infrastructure.
E:        Request for new Regular Customs Commissionerate:
1. Introduction:- Customs (Preventive) Commissionerate, Jodhpur is having jurisdiction over the entire state of Rajasthan comprising 132,140 square miles (342,239 square kilometres) of land area including 1037 kilometre long International Boarder with Pakistan spread across four districts of Rajasthan i.e.Sriganganagar, Bikaner, Jaisalmer and Barmer.
The Anti-Smuggling task along the entire International Border is being handled by 5 Customs Divisions, four of them located at the headquarters of the four districts having international border with Pakistan. One division is having its headquarters at Jodhpur. 17 Customs Ranges are working under these five divisions and the same are located at places near the international border. Ranges are manned by one Superintendent and three Inspectors each. An office of the Additional Commissioner is working at Jodhpur to effectively supervise the anti-smuggling task being performed by these formations.
2. No regular posts at ICDs etc. in cadre restructuring 2002:- Customs (General) work is also being handled by this Preventive Commissionerate. At the time of the last cadre-restructuring in the year 2002, the following facilities were in existence under this Commissionerate:-
·         Inland container depots- Jaipur-2, Jodhpur-3 & Bhilwara-1
·         Air cargo complex, Sanganer, Jaipur-1
·         Foreign post office- Jaipur-1
However, no regular posts were sanctioned for these facilities at that time and the work was being handled by ad-hoc posts.
3. Additional facilities created after cadre restructuring of 2002:- It is further stated that after the cadre-restructuring in the year 2002, the following additional Customs facilities have been created in the jurisdiction of Customs (Preventive) Commissionerate, Jodhpur:-
       ·         International Airport, Sanganer Jaipur,
·         Land Customs Station (Rail), Munabao (Barmer),
·         Inland Container Depot, CONCOR, Kota,
·         Inland Container Depot, RAJSICO, Bhiwadi,
·         Air Cargo, Jaipur City.
            However, additional staff has not yet been sanctioned for deployment at these facilities and temporary arrangement has been made by drawing staff from various formations of this Commissionerate for deployment at these formations.
The strength sanctioned for customs in restructuring 2002 was meant only for the working of a Customs Preventive Commissionerate in the state. However, regular staff was not sanctioned for Customs (Import and export) facilities in the state rather ad-hoc posts were sanctioned for these facilities. Now that the cost-recovery regime has been discontinued and consequently the ad-hoc posts are not being filled up, there is an acute shortage of staff for manning these facilities. As a stop-gap arrangement these facilities are being manned by diverting staff from the preventive formations.
4. International Airport, Sanganer & LCS Munabao;- Further, no additional staff strength has been sanctioned for the Land Customs Station at Munabao (Barmer) and the International Airport at Sanganer (Jaipur) which are also being manned by diverting staff from other formations. Hence, a large number of officers have been diverted from the preventive operations which adversely affect the working of the preventive formations. As a matter of fact, the present sanctioned strength of the Commissionerate can not be spared for these facilities. Hence, fresh sanction of staff for these facilities as detailed below is essential:-  
 (i).      International Airport, Jaipur;- Jaipur, being a major place of tourist interest, possibilities of greater number of chartered and direct International flights landing at Jaipur in the coming days are very bright.

 This airport was not operating in the international sector at the time of last cadre restructuring hence, there was no question of sanction of posts at that time. Now the airport has been accorded international status and at least three international flights (to Dubai, Sharjah and Oman) are operating daily from this airport. Presently this airport handles around 800 passengers a day and the number is expected to grow in future with introduction of new international flights.(BANKOK in Dec.2013). Expected future growth in the number of passengers is detailed below:- 
1.      Since Jaipur is a major tourist destination it is expected that the number of international tourists will grow with introduction of new flights. 
2.      The export and import of gems and jewellery is growing fast and a large number of international passengers will be contributed by the importers/ exporters of gems and jewellery. 
3.      Rajasthan and especially Shekhawati region supplies a large number of manpower to the Arab courtiers. These persons working in the gulf are regular passengers and their number is growing at a regular pace. 
4.      Direct Haz flights from Jaipur airport have since become operational and the number of passengers going for Haz from Rajasthan is quite large.  
5.      International flights for Delhi airport are many times diverted to this airport in view of adverse weather conditions or congestion. 
6.      International Airport, Sanganer is going to be accorded the status of fully functional international airport with effect from the year 2008.     
Since the staff requirement for the Jaipur Airport has been drawn assuming movement of approximately 800 passengers each day, Airport would require to be manned on double shift basis.  
          Accordingly, three posts of DC/AC, one each for the two shifts and third for the Preventive / Intelligence would be required. Similarly, thirty Inspectors would be required, 15 each for the two shifts, six for the Customs counters in Arrival Hall, three in Departure Hall, one each in both the Halls as PRO / Help Desk / Conveyor Belt/ X-Ray, three Inspectors for the AIU and two others for Administrative / Warehouse / Leave reserve. Ten Superintendents would be required on per shift basis, considering one for the two counters, thus requiring six Superintendents in both the Halls, two for the AIU and the other for Administrative / Escort Duty / Leave Reserve etc. 
Hence, the requirement of staff for International Airport would be as under:-

(ii).     Land Customs Station (Rail), Munabao:- This land Custom Station is most sensitive in respect of smuggling as well as and national security. The rail link between Munbao(Raj) and Khokrapar (Pak.) has been functional in full fledged manner w.e.f. 18.2.2006 on weekly basis.
In the year 1987, the Ministry has sanctioned 54 posts in different cadres vide their letter F.No. A-11013/20/85 Ad.IV dated 7.01.87 with condition that “the filling up of the posts for manning the LCS at Munabao will however coincide with the opening Rail link with pakistan in Rajasthan Section. The date for filling up of these posts will be notified separately by CBEC in consultation with IFU”. (Annx.C)    
The LCS has become operational and the work related to customs clearance is being handled by Customs staff drawn temporarily from other preventive posts at the border. No extra posts have arrived in the name of this increased work. Moreover, it brings lots of travel hazards to the staff posted at various customs stations, while they attend clearance work on Saturday and Sunday at Munabao (Raj). The LCS Munabao earnestly needs staff for its smooth functioning and better administrative monitoring.
At the time of opening of this facility in the year 1987 the Ministry had sanctioned vide their letter dated 07.01.1987, 54 posts in different cadres. Now that the LCS has become operational, sanction of staff is urgently needed. In response to a request (letter C. No. II-39(24)Cus./Estt./2003/Pt.I/15985 dated 21.12.2004)  for sanction of additional staff for Munabao Rail Customs Station, the Ministry informed (vide letter F.No. A-11013/01/2005-AD.IV dated 28.09.2005) that there was no buffer strength available with the Ministry in any grade to meet the additional requirement. Now since additional staff sanction is being considered by the Ministry it may also be kept in mind that the weekly train is likely to be run thrice a week in view of the greater number of passengers desirous of traveling by this train and there is also a likelihood of a cargo train/ truck facility being started for goods trade between India and Pakistan. 
While drawing up the proposal for sanction of the following posts for this facility it has been kept in view that preventive angle is always required to be kept in mind while clearing passengers to and for Pakistan in view of past experience while faster clearance of international passengers is an international responsibility of every nation but making checks on anti national activities is also required. Hence, the requirement of staff for LCS (Rail) would be as under:-

 5. Growth of Import-Export:- An important point worth consideration is that the Customs (Import & Export) work has significantly grown over these years. An inland container depot has started functioning since March 2005 in Kota which caters to the needs of exporters of stone from Kota-Bundi region of the state.  Another inland container depot has started functioning at Bhiwadi (a fast growing industrial estate near Delhi). An air cargo complex has also become operational in the heart of Jaipur city to cater to the needs of gems and jewellery sector which has a huge potential in the future in terms of both imports and exports.  All these Customs facilities have grown considerably in terms of volume and value of imports and exports as also revenue as detailed below:-

               Besides the above it is also necessary that one post of Additional/ Joint Commissioner is sanctioned for every two facilities for better administration in terms of assessment/ adjudication/ disposal and faster Customs clearance besides improvement in preventive performance. 
Keeping in view the future growth of trade it is expected that export of agriculture products from Bikaner and Sriganganagar districts of the state will need opening of separate inland container depots at those locations. Wooden handicraft will be another important export product at those locations. Export of wooden handicraft from Churu and Sikar districts of the state is also expected to grow with the opening up of new facilities nearer to the places of manufacture of these items. However, this aspect is not being taken into account for the present and the plan has been prepared for the presently existing facilities only. 

            6. Total  additional staff requirement for Customs:- In view of above, the total additional staff requirement in the grades of DC/ AC, Superintendent and Inspectors for all these customs facilities will be as under:-

          In addition to above, at least six posts of Additional/ Joint Commissioner are also required to be created as follows:- 
1.      For International Airport- One post
2.      For LCS Munabao- One post
3.      For 11 other facilities- Five posts 
Sir, keeping in view the above workload and requirement of staff it is imperative that one regular customs Commissionerate is created in Rajasthan. Since the import and export work is spread across the state, this Commissionerate may have headquarters at Jaipur.
Sir,    A detailed proposal for requirement of  additional posts for customs Rajasthan  to increase operational efficiency was also sent by the worthy Commissioner (Customs) Jaipur to the Chief Commissioner (Customs Preventive) Delhi Zone, New Delhi vide letter C.No.II-31(1) Estt./ Cus/2009/10939 dated 6.11.09 (copy enclosed as B)
          Sir, The Customs (Preventive) Zone, Delhi consists of 3 Customs (P) Commissionerate - at Delhi, Amritsar & Jodhpur but despite of allocation of substantial number of posts in the last CR-2002, no new post was sanctioned to Customs Preventive Commissionerate Jodhpur(RAJ.) In the Cadre Restructuring-2002, all the new sanctioned posts for Customs Preventive Zone, Delhi were allocated to the Customs Preventive Commissionrate, Delhi & Amritsar.
        Most Revered Sir, it is most humbly requested that on the basis of my submissions made above, a revised proposal should be forwarded to the CBEC and DGHRD strongly recommending our genuine demands, reproduced in brief as under:- 
i.                Formation of 2 new Service Tax Commissionerates as per submission made above;
ii.                Formation of 1 new regular Customs  Commissionerate as per submission made above;
iii.              Allocation of more vacancies to the existing Customs Preventive Commissionerate on the basis of submissions made above.
